En el estado de Texas, un DWI por sus siglas en ingl\u00e9s (Driving While Intoxicated) o un DUI (Driving Under the Influence) pueden ser catalogados como un delito menor o una felon\u00eda.<\/p><p>Al ser catalogado como un delito menor (misdemeanor), este puede ser considerado clase B o clase A. Y esto va a depender de ciertos factores, entre ellos, el nivel de alcohol en la sangre o si ha tenido alg\u00fan DWI en el pasado. Estos a su vez conllevan una pena m\u00e1xima de hasta:<\/p><p>clase B:<\/p><ul><li>Nivel de alcohol en la sangre &gt; .08 y &lt; .15.<\/li><li>6 meses de c\u00e1rcel y\/o hasta $2,000 d\u00f3lares de multa.<\/li><\/ul><p>Clase A:<\/p><ul><li>Nivel de alcohol en la sangre &gt;15 o segundo DWI.<\/li><li>1 a\u00f1o de c\u00e1rcel y\/o hasta $4,000 d\u00f3lares de multa.<\/li><\/ul><p>De igual manera, si iba acompa\u00f1ado de alg\u00fan menor de edad, es su 3er DWI o m\u00e1s, o ha causado un accidente, este delito podr\u00e1 ser catalogado como una Felon\u00eda. La cual conlleva posibles condenas m\u00e1s severas.<\/p><p>Es importante saber que un arresto NO SIGNIFICA QUE YA SEA CULPABLE. Esto significa que mientras se encuentre bajo el l\u00edmite, no ser\u00e1 considerado intoxicado bajo la ley.<\/p><p>El problema con esto, es que una vez que la polic\u00eda detienen a una persona y el oficial tienen causa probable para arrestar al individuo, es decir si bajo criterio del oficial es posible que el individuo se encuentre intoxicado; el oficial podr\u00e1 ejecutar un arresto. Una vez bajo arresto, se obtendr\u00e1 una prueba de sangre para comprobar el nivel de alcohol en la sangre y este resultado puede demorar meses.<\/p><p>Es posible que durante el proceso, su abogado pueda desechar la evidencia debido a incongruencias o errores por parte de los oficiales o la fiscal\u00eda.
